Tax breaks for the purchase of compostable packaging

The Budget Law 2023, Art. 1, paragraphs 685-690, L. no. 197/2022, re-proposed the tax credit for the purchase of biodegradable and compostable packaging in compliance with UNI EN 13432. The tax break is reserved for businesses that purchase recycled products or products made from biodegradable and compostable materials in 2023 and 2024. The credit is 36 percent of the expenses incurred and can go up to a maximum amount of 20,000 euros per year.

What does the standard say?

The rule grants all businesses a tax credit equal to 36 percent of expenses incurred and documented, in 2023 and 2024, for the purchase of:

  • Products made from materials from the separate collection of plastic packaging.
  • biodegradable and compostable packaging according to UNI EN 13432 or derived from the separate collection of paper, aluminum and glass.

The tax credit will be granted up to a maximum annual amount of 20,000 euros for each beneficiary, with an overall limit of 5 million euros annually for the years 2024 and 2025.

One of the basic requirements for receiving the subsidy is to obtain a certificate on the expenses incurred, which is intended to verify and certify the technical requirements of the products purchased. This attestation can be issued by different professionals:

  • chairman of the board of auditors
  • registered statutory auditor
  • accountant
  • labor consultant
  • responsible for the tax service center.

How to apply for the facility?
